This page provides the terms of sale and purchase for subscriptions offered by The Activist, Inc. (“The Activist” or “we” or “us”). In these terms, unless the context otherwise requires, all further references to “you” and “your” means you as an individual customer, including the individual purchaser of a group subscription, whether such individual is a natural person or a non-natural person.

1. General Terms of Sale
1.1.1 “Account” means the account created on our Website by you or on your behalf to access our Paid Services.
1.1.2 “Content” means all materials published or available on the Services, including, but not limited to, texts, graphics, photographs, images, videos, audio recordings, livestreams, designs, templates, “look and feel,” computer code, data, metadata, compilations, and any enhancements and modifications thereto and derivative works thereof.
1.1.3 “Free Services” means access to certain Content we offer free of charge at our sole discretion. “Paid Services” means paid subscriptions to our email newsletter, paid access to our archive of back issues, and all other benefits we provide exclusively to paying customers at our sole discretion. “Services” means collectively the Free Services and the Paid Services.
1.1.4 “Renewal Date” means the date on which one Subscription Term ends and another Subscription Term automatically begins.
1.1.5 “Subscription Term” means the complete length of time a subscription is in effect (one month or one year). “Initial Term” means the Subscription Term immediately following your first purchase of a subscription. “Renewal Term” means each subsequent Subscription Term after the Initial Term.

1.2 About subscriptions
You are not required to purchase anything for certain restricted access to our Content. However, if you do not purchase a subscription, your access to our Content will be limited. You can review the subscriptions we offer here. We reserve the right to modify our Content and the type, availability, and prices of our Services at any time. Only one person may use the user name and password associated with an Account. For details about your subscription, including payment methods and billing cycles, please see your My Account page.
1.3 Processing and payment
We will process your purchase as promptly as possible. There may be a delay in the activation of your Paid Services while payment details are verified. We accept major credit cards and PayPal. We reserve the right to reject any order or purchase at any time. If your initial payment authorization is later revoked, your access to Paid Services will be terminated. Please contact us if you believe your access was terminated in error. Unless specified otherwise in our Cancellation and Refund Policy, all charges are nonrefundable. To view or change your payment method, please log into your My Account page and click on Payment Methods.
We may receive updated credit card information such as a new credit card number or an updated expiration date from your credit card issuer. The updated credit card information is provided to us at the election of your credit card issuer. We are not responsible for the distribution of your updated credit card information. Your credit card issuer may give you the right to opt out of the update service. It is your responsibility to contact your credit card issuer with regard to your right to opt out of the update service.
1.4 Free trial policy
By submitting an order for a subscription on our Website, you are authorizing us to use the payment method you provided at checkout to charge a subscription fee at the end of a free trial period. Your free trial period begins on the date that you submit your order and continues for twenty-one (21) calendar days. During your free trial, you will receive all new issues of The Activist email newsletter that we publish. You will not receive access to our archive of back issues until your paid subscription begins. At any time before your free trial ends, you may cancel your subscription without being charged a subscription fee. To cancel a subscription, log into your My Account page and click on My Subscription. If you need help, please contact us. If you submit an order for a group subscription, you will receive one free trial period, which will begin on the date that you submit your order and continue for twenty-one (21) calendar days. If you add members to your group after your free trial ends, you will not receive free trials for those members, and you will be charged for those members immediately upon adding them.
At any time during your free trial, we reserve the sole and exclusive right to revoke your free trial and put your Account on hold in the event that we reasonably determine that you are not eligible due to any abuse of the free trial or otherwise. Each customer may receive a free trial only once. If a customer renews a subscription, renews a lapsed subscription, or cancels a subscription during or after a free trial, or if a free trial otherwise ends for any reason, the customer will not be eligible for another free trial. If we discover that a customer has multiple free trial Accounts, we reserve the right to restrict or terminate any one or more of such Accounts at our sole discretion.
1.5 Automatic Renewal Policy
By submitting an order for a subscription on our Website, you are authorizing us to use the payment method associated with your Account to charge a recurring subscription fee automatically at each Renewal Date until you cancel your subscription. Your subscription will automatically renew at the end of each Subscription Term continuously and indefinitely for a period equal to the Initial Term. Fees will be charged automatically to your payment method at the beginning of each Renewal Term on the calendar day corresponding to the beginning of your Initial Term. You can cancel a subscription or change a payment method at any time by logging into your My Account page and clicking on My Subscription or Payment Methods, respectively. If you are enrolled in an annual subscription, we will notify you by email at least fifteen (15) calendar days before each Renewal Date. If you are enrolled in a monthly subscription, we will not notify you before renewal unless your subscription price is scheduled to increase. A subscription fee will be charged to you at the price that is in effect at each Renewal Date. Where permitted by law, we reserve the right to increase the price of your subscription on any Renewal Date. However, we will notify you by email at least three (3) calendar days before your subscription automatically renews at an increased price. We will not increase the price of a subscription more than once a year and more than 50% in one year.

2.1 Cancellation during free trial
If you cancel a subscription during a free trial, you will not be charged a subscription fee. Your free trial will end upon cancellation of your subscription. To cancel or change a subscription before a free trial ends, log into your My Account page and click on My Subscription. If you need help, please contact us. 2.2 Cancellation after free trial
If your free trial ends before you cancel your subscription, we will use the payment method associated with your Account to charge a subscription fee on the date the free trial ends. Your subscription will begin on the date you are charged and will continue for the Initial Term (one month or one year).
When you cancel a subscription after a free trial, you cancel only future renewals of your subscription. You may notify us of your intent to cancel at any time, but the cancellation will become effective at the end of your current Subscription Term. You will not receive a refund for any portion of the current Subscription Term. You will continue to have the same access and benefits of your subscription until the current Subscription Term ends. You can cancel or change a subscription at any time by logging into your My Account page and clicking on My Subscription. If you need help, please contact us.
2.3 Cancellation by us
We reserve the right to suspend or terminate your subscription for any reason, with or without notice and without further obligation. You will not be entitled to a refund in these circumstances. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
2.4 Changes to subscriptions
You may change your subscription from monthly to annual or from annual to monthly at any time by logging into your My Account page and clicking on My Subscription. If you need help, please contact us. When you change your subscription, you will receive a pro-rated credit toward your new subscription. We reserve the right to issue credits at our sole discretion. If we issue a credit, we are under no obligation to issue the same or similar credit in the future.
2.5 Changes to Services
We reserve the right to make changes to our Services at any time, including changes to Content provided through the Services. If we temporarily reduce or eliminate the charge for Paid Services that you are currently paying for under different terms, you will not receive a refund. If any or all of our Services are temporarily unavailable, you will not receive a refund. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
2.6 Late or missing refunds
We and our payment processor will make every attempt to process your refund as quickly as possible. Your financial institution can take up to ten (10) business days to reflect your refund in your bank or credit card account. If you haven’t received a refund you were expecting, please check your bank or credit card account again. Then contact your bank or credit card company. If you have taken all of the foregoing steps and still have not received your refund, please contact us.
3. Changes to these Terms of Sale
We may, from time to time, change these Terms of Sale. When such changes are made, we will make a copy of the new Terms of Sale available to you on the Website. If you do not cancel the Services after the changes become effective, you agree to the changed terms.
